Mobile Phone Services Terms and Conditions Before you register as a user to this website, please ensure you read and are willing to comply with all the terms and conditions stated in this document. All Copy Phones ar sold strictly by MPS China Ltd. by law we not allowed to sell Copy Phones at Mobile Phone Services Ireland.(‘Mobile Phone Services' ‘we' or ‘us' = Mobile Phone Services; ‘you' ‘the customer' = you) 1. The Contract between you and Mobile Phone Services We must receive absolute payment for the cost of the goods that you order before your order can be confirmed. Once payment has been received and acknowledged by MPS China Ltd. , we will confirm your order has been accepted by sending an e-mail to you at the e-mail address you have providing in your order form. Our acceptance of your order will bring about a legally binding contract between us. Orders will not be accepted from those under the age of 18, only those able to enter into a legally binding transactions may use the website or order goods. 2. Mobile Phone Services Pricing and Delivery i) The prices payable for each individual item available will be clearly stated on our website. ii) All of our prices are quoted in EUR, Euro. You will be invoiced in Euro and if you make a purchase from outside the EU, currency fluctuations and credit card charges could vary and we will have to charge according to the current rate of exchange when transaction is initiated. iii) You may be required to pay extra for delivery and it might not be possible for us to deliver to some locations. Our delivery charges are set out in the order process. 3. Your right to cancel or amend your order i) You will be able to cancel or amend any order that has not been: a) worn b) damaged c) tampered with Within 7 working days of receipt of your goods in original Packeting. ii) To cancel or amend your contract (order) you must alert us by e-mail or telephone us within 7 working days of delivery. (Please note: we are unable to exchange or offer a refund for the purchase of goods due to hygiene regulations) 4. To return your goods to Mobile Phone Services 1) Call or email us within 7 working days of receipt of purchase and ask for a ‘Returns Authorisation number'. 2) Your ‘Returns Authorisation number' should be written on the outside of the package being returned. 3) If you are returning your item, you may use the prepaid Delivery and return to us by Special Delivery. The item(s) must be packed securely in the packaging in which you received it. We are not liable to refund you if the goods is returned to us broken. 4) Once we have received the item(s) and confirmed safe delivery we will refund the amount due to the credit or debit card in question. 5. Cancellation by Mobile Phone Services On the rare occasion in which we may be forced to cancel our contract, we do reserve the right to do so if: i) We have insufficient stock or a stock line has unexpectedly become defunct ii) We are unfortunately unable to deliver to your postal zone iii) There has been a typographical error on our part in the pricing information If we do have to cancel your contract we will endeavour to notify you as soon as possible - we will either credit your refund to the applicable card or offer a credit note for future use. 6. Dispatch and Delivery of goods to you i) When ready to despatch your goods we will use the address supplied by yourselves when registering or completing the order form. It is entirely your responsibility to ensure that the address is correct and complete and a person is present at said address to sign for delivered goods. ii) All orders are delivered using Mail Special Delivery. ii) You will become the owner of the goods you have ordered when they have been dispatched from our warehouse to you. Once your goods have been delivered to you they will be your responsibility in their entirety. 7. Mobile Phone Services Liability i) Once in possession of goods which you believe are not what you intended to order, you have 7 working days to contact Mobile Phone Services - if you fail to communicate the error within that time frame - we hold no liability. ii) If there is a delay beyond our normal delivery schedule stated we accept no liability if you have failed to alert us to this issue within 14 working days of dispatch. iii) If you should contact us alerting us to a problem regarding a failure of delivery within the allotted 14 days, we shall make a refund in a way we deem appropriate. iiii) If there is any problem arising due to our negligence or human error, we shall of course credit appropriate credit/debit card as soon as possible. v) Mobile Phone Services cannot be held responsible for any delays once the goods have left us and are in possession of the courier or Mail or approved courier. 8. Notices Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent by e-mail to our contact address. 9. Invalidity If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected. 10. Privacy You acknowledge and agree to be bound by the terms of our privacy policy. 11. Third Party Rights No party is able to represent Zoe Russell goods who has not signed up to our Terms and Conditions. 12. Governing trade laws Without exception, every transaction that takes place on the Mobile Phone Services site is bound to abide the laws set by Republic of Ireland. 13. Trade Marks, Images and Logos MPS China Ltd. is the operator of www.Mobile Phone Services.eu .com .de .org . Any images, text, icons, logos are the possession of Mobile Phone Services, we give no permission for unwarranted use of our such items. 13. Our agreement in its entirety These Terms and Conditions, alongside our current website prices, delivery charges, Mobile Phone Services contact details, stock details plus our Privacy policy are current and applicable, any misrepresentation afforded to our Mobile Phone Services website is beyond our control and therefore we will not hold ourselves liable. 14. Events Beyond our Control We will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident. |
